General provisions

  1. This document defines the rules for the processing and protection of personal data of users of www.jamicon.pl.
  2. Customers’ personal data administrator within the meaning of the act on Personal Data Protection Act is the Service Provider - "JAMICON Spółka Jawna" with its office in Katowice at Barlickiego 8, 40-820 Katowice, entered into the register of entrepreneurs of the National Court Register kept by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register with KRS number 0000205071, NIP number 634-23-02-262, REGON number 276247488, GIOŚ number E0003072W.
  3. Service Provider processes personal data according with the provisions of Polish law and complies with the principles of protecting the privacy of customers provided for in the Personal Data Protection Act.

Personal data processing policy

  1. The Privacy Policy applies to personal data processed on the Website in order to enable the use of its functionalities, including those collected automatically during Website visits, in particular:
    a) for registration on the Website;
    b) for the purpose of submitting claims and handling complaints;
    c) in order to publish the content.
  2. In order to accomplish RMA claims, the Service Provider collects the following data: full name, phone number, address (street, house number, town and postal code) or other data provided by the Service Provider on the Website or during contact with Customer.
  3. The Service Provider declares that providing the data marked on the Website as required is voluntary, but necessary to use selected functionalities of Website, including in the case of data indicated in point 5 and 6 for accomplish RMA claim.
  4. Customers' personal data are collected by the Service Provider to enable functionalities available on the Website in order to:
    a) handling the Content publication process and related functionalities,
    b) pursuing claims,
    c) creating reports and analyzes for the needs of the Service Provider regarding the functioning of the Website, including the viewing statistics of the Website pages,
    d) adapting the Website to the customers needs,
    e) fulfillment of warranty (RMA) claims.
  5. Irrespecting of the above, if the Customer gave a separate consent, the Customer's personal data are processed by the Service Provider in order to:
    a) Service Provider’s marketing activities and the marketing activities of entities cooperating with the Service Provider, especially to organize promotions, contests and accomplist other marketing tools,
    b) receive commercial information, especially an ordered Newsletter sent by Service Provider to e-mail address provided by the Customer.
  6. Service Provider informs, that customer data are also collected automatically while using the Website. This data can be collected in the Website's system logs, by cookies and by the Web Beacon system.
  7. Service Provider informs, that since Customer connects to the Website, information about the number (including IP) and type of the end-device Customer is using from which the Customer connects to the Website appears in the Website's system logs. Service Provider informs, that - in accordance with the law - it also processes data, regarding the number (including IP) and type of the end-device Customer is using, as well as the time of the Customer's connection with the Website and other operational data connected with Customer's activity on the Website. The data described are processed for technical purposes in order to adapt the Website to the Customer’s needs and to collect general statistic information about Website functioning.
  8. Service Provider uses Cookies to collect information related to the use of the Website by the Customer. Cookies are data, usually small text files, saved and stored on device through which Customer uses the Website, which enable:
    a) keep Customer's session (after logging in), thanks to which the Customer doesn’t need to re-enter Login and Password on each subpage of the Website,
    b) adjusting and optimizing the Website to the customers’ needs,
    c) creating viewing statistics for the Website's subpages,
    d) personalization of marketing messages,
    e) ensuring the safety and reliability of the Website.

    Website uses session cookies, which are deleted when web browser window is closed, as well as persistent cookies, saved for a specified period of time on the devices through which the Customer uses the Website.

    The Customer may change the Cookies settings, specifying the conditions for their storage and access Customer's Device by them and at any time by himself. Those changes can be made by the Customer using the web browser settings or by configuring the service. Settings can be changed in a way as to block the automatic handling of cookies in the web browser settings or to inform about each saving of Cookies on the Customer's device. Detailed information about possibilities and methods of getting handle with cookies is available in the client's software (web browser) settings.

    The customer may delete cookies using the functions available in the web browser he uses at any time.

    Restricting the use of cookies may affect some of the Website functionalities.

    The Website also uses Cookies posted by the Service Provider's partners, enabling the personalization of advertising activities and accounting its effects. The Privacy Policy does not regulate the way of using cookies by third parties. More information about these Cookies may be available on individual websites of the Service Provider's partners.
  9. Some subpages of the Website and other means of communication with Customers may contain so-called "We-beacons" (so-called „electronic pictures”, also known as „blank GIFs”). Web Beacons allow you to receive information such as the IP (Internet Protocol) address of the computer on which the page with placed Web Beacon was loaded, the URL address of the page, the time the page was loaded, type of browser, as well as information contained in Cookies, to score the effectiveness of advertising.

Service Provider's rights and responsibilities

  1. Service Provider reserves rights to reveal selected information about the Customer to the competent authorities or third parties who submit a request for such information, based on an appropriate legal basis, in accordance with the provisions of applicable law.
  2. Service Provider declares, that he entrusts processing of Customer's personal data or other data referred to in the Privacy Policy, on the basis of a written agreement concluded in accordance with art. 31 of the OODO Act to entities providing hosting, administration, maintenance and services management, as well as services connected with optimization and campaign management.
  3. Service Provider declares, that he entrusts the processing of the Customer's personal data or other data referred to in the Privacy Policy to other entities providing services for the Service Provider or directly to the Customer in terms necessary to use the Website, including finalizing Order / Reservation, consideration of RMA claim and use of financial services available on the Website, on the basis of a written agreement concluded in accordance with art. 31 of the OODO Act.

Customer rights and obligations

  1. The Customer may submit an application to the Service Provider (regarding personal data) for:
    a) correct data;
    b) delete data which are processed without any reason or placed on our websites;
    c) restrict data processing (suspension of data operations or non-deletion of data – according to submitted application);
    d) data access (information about the data processed by us and get a copy of the data);
    e) data transfer to another data administrator or to the Customer (in a way specified in art. 20 of the GDPR).
  2. Each customer has the right to access, correct, supplement, to request of discontinuing processing and removal their personal data. For this purpose, please send an e-mail to the biuro@jamicon.pl or call us 32 200 02 55.
  3. In case of Service Provider requests you to agree to send commercial information by electronic means (e.g. via e-mail, SMS etc.), the person who agreed has the right to withdraw consent. To do this, send an e-mail to biuro@jamicon.pl ("resignation" as topic), call us 32 200 02 55 and inform about the withdrawal of consent or write to us about the withdrawal of consent to receive commercial information on Service Provider's address: JAMICON Spółka Jawna ul. Pod Młynem 19A, 40-313 Katowice, POLAND.
  4. If the Customers places any personal data of other people on the Website (including their full name, address, telephone number or e-mail address), they may do so only on condition that they do not violate the applicable law and personal rights of these persons.

Data safety

  1. The Service Provider declares that he makes efforts to provide Customers a high level of security. Any events affecting the security of information and data transmission, including the suspicion of sharing files containing viruses and other similar files or other than files which contains destructive mechanisms, should be reported to the Service Provider using address biuro@jamicon.pl.
